These terms and conditions apply to donations made by natural and/or legal persons (‘donating party’) via the website applemuseum.nl .

1. Purpose of donation

Donations made through the applemuseum.nl website benefit the Apple Museum Foundation, located in Utrecht, beneath Liemès at The Wall, registered in the Trade Register under number 86018515 (referred to in these terms and conditions as the “Apple Museum”). The Apple Museum is a foundation with ANBI status, all funds of which benefit the Apple Museum. The purpose of this donation is to finance acquisitions or projects in the areas of education, research, and restoration. The Apple Museum’s income and expenditures are accounted for annually in its annual report.

2. Applicability

These terms and conditions apply to every one-time donation made by a donating party to the Apple Museum via the applemuseum.nl website . The donation is a private donation, meaning it does not need to be recorded in a notarial deed.

3. Rights and obligations of the donating party

3.1 To make a donation, the donor must be at least 16 years of age or have parental or guardian approval for the amount to be donated. By accepting these terms and conditions, the donor declares that this is the case.
3.2 The donating party only makes donations from its own resources or from resources over which it has full control.
3.3 The donating party declares that it will not impose any further conditions on the donation other than that the donation will be used for the purpose described in Article 1.
3.4 Once the amount corresponding to the donation has been credited to the Apple Museum account, the donation cannot be revoked.

4. Rights and obligations of the Apple Museum Foundation

4.1 Online donations will benefit the Apple Museum in full.
4.2 Except for the obligation to use the donation for the purpose stated in Article 1, the Apple Museum accepts no other obligations in return for the donation.
4.3 The data provided by the donating party will be processed and stored in accordance with the “Privacy Statement”.

5. Liability

5.1 The transaction (the donation transfer, via iDeal or otherwise, to the Apple Museum’s bank account) is carried out by the donating party and independent third parties (payment providers). The Apple Museum cannot be held liable in any way for any damages or costs incurred as a result of or in connection with the transaction.
5.2 The donating party indemnifies the Apple Museum against any damage caused by or in connection with the donation, including any action or omission by the donating party that violates these terms and conditions.

6. Final provisions

6.1 Dutch law applies to the donation and these terms and conditions. Any disputes will be submitted exclusively to the competent court in Utrecht.
